U.S. Justice Department Rejects #CivilRights Complaint Filed for Murder of #RaymondMattia by #USBorderPatrol
By #OpheliaRivas, O'odham Voice Against the Wall, via #CensoredNews, January 6, 2025
"The system of justice for the killing of an American Indian is as expected by the people. The numerous federal agents on the Tohono O'odham reservation are justified in killing our people as they will not be held accountable by the system that pays them to be heavily armed and unmonitored on our land.
"The border patrol have not been prosecuted for deaths, rapes, molestations and human and drug trafficking.
"The Criminal Section of the Civil Rights Division at the Department of Justice wrote to me:
"'The tragic death of Raymond Mattia, who was shot and killed at his home, by officers of U.S Customs and Border Patrol agents Whitehouse, SiFuentes, and Torralva, on May 18, 2023.'
'Mr. Mattia’s death was indeed a tragic loss. Mr. Mattia’s death was indeed a tragic loss. However, the information provided about the circumstances surrounding his death does not disclose a prosecutable violation of the federal criminal civil rights statutes enforced by the Criminal Section. Therefore, we regret that we are unable to assist with this matter."

U.S. Border Patrol Agents who Murdered #RaymondMattia, #TohonoOodham, Identified
Tucson Sentinel, reporter Paul Ingram, reports: "Three #BorderPatrol agents involved in the fatal shooting of a Tohono O'odham man in front of his home in 2023 were identified in legal filings on Friday.
"Earlier this year, the family of 58-year-old Raymond Mattia filed a lawsuit, accusing Border Patrol of excessive force and demanding the names of the agents who killed him.
"Attorneys Ryan Stitt and Marcus Bourassa filed an amended complaint, and on Friday issued a summons for Border Patrol Agents Scott Whitehouse, Dan Sifuentes, and Ivan Torralva, who they said 'shot and killed Raymond for no reason.'
"'Despite the lack of a threat and his compliance, at least three of the agents met his compliant calm demeanor with a hail of gunfire,' the attorneys wrote. Whitehouse, Sifuentes, and Torralva 'all fired their weapons at Mr. Mattia."

U.S. Justice Department Complaint Filed for the Murder of #RaymondMattia, #Tohono #Oodham, by U.S. Border Patrol and Tribal Police
Civil Rights Complaint filed by Ophelia Rivas, O'odham Voice Against the Wall, and Signees
November 28,2024 Press Release, via #CensoredNews
"A complaint has been filed on November 7, 2024 with the Civil Rights Section of the United States Department of Justice seeking justice for violation of Mr. Raymond Mattia Sr. civil and constitutional rights.
"The unjust decisions made thus far are a blatant cover-up of biased processes and laws pertaining to American Indians.
"We strongly urge immediate compliance with the Interagency Memorandum of Agreement on December 1, 2022, regarding criminal investigations on Indian Country in the homicide of Raymond Mattia Sr.
"The Interagency MOU press release states, 'Department of Justice is committed to working with the Department of Interior and the FBI is committed to ongoing and continued collaboration with the Bureau of Indian Affairs,' said FBI Director Christopher Wray' on December 2, 2022.
"The Arizona prosecutor ruled there was a 'just cause' of 38 shots and 11 bullets striking a peaceful unarmed American Indian man.
"Raymond Mattia Sr. had called tribal police for assistance, undocumented persons had entered his home demanding the use of his cellphone. Ray stepped out of his one-room home doorway as shown on the Homeland Security border patrol body cameras and complied to the demands of over 10 border patrols and 1 tribal police.
[Graphic description of Raymond's murder has been omitted]
"According to Zach Stoebe, public affairs with the U.S. Attorney for the District of Arizona, the homicide of Raymond Mattia Sr. is, 'a case that does not rise to the level of a federal criminal civil rights violation or a criminal violation in Arizona law.' (USA Today, Oct. 16, 2023)
"We call for justice for an American Indian man, Raymond Mattia Sr., a human, an O'odham, a member of the federally-recognized Tohono O'odham Nation. Ray is a father, a brother, a hereditary ceremony leader, a community councilman and a friend with a Right to Live and Exist.
"This is the legacy of the United States of America regarding the American Indian. Truth Day November 28, 2024."

It's great that Joe Biden is apologizing for genocidal Indian boarding schools in the US, but it rings a little hollow when it's used as a blatant campaign stunt. If there's one thing indigenous people still have, it's memory. Biden could have made an apology at any point in his term and people would have remembered, and it sure would have come across more sincere than 10 days before an election.
---
"Speaking at Gila River Indian Community today, Biden made no apologies for the tens of thousands of Palestinian children murdered with U.S. bombs that he has sent to Israel. Biden made no apologies for his war crime of sending U.S. white phosphorus to Israel for genocide.
"Interior Sec. Deb Haaland made no apologies to Tohono O'odham and San Carlos Apache for bulldozing their ancient villages and burial places for transmission lines. Haaland made no apologies for allowing a Canadian company to dig into the Paiute Massacre Site for lithium. Haaland made no apologies for issuing a permit to an Australian company to drill into Hualapai's ceremonial place for lithium in Arizona.
"Instead, they used the crimes against Native American children in boarding schools for the advancement of their political campaign."

Dangerous Low Flying Jets Target More #Tohono #Oodham, #Apache and #Yaqui Communities
via #CensoredNews, Oct 5, 2024
Wild Earth Guardians:
"The Threat: The U.S. Air Force is proposing low-level fighter jet maneuvers and supersonic flights over White Mountains, Organ Pipe Cactus National Park, and more. It will affect the Tohono O’odham Nation, #WhiteMountain and #SanCarlosApache Nations, and #PascuaYaqui Tribe.
Wilderness and Sacred Places at Risk
The Wilderness areas at risk include the Gila and Blue Range Wildernesses in New Mexico, plus the following Wildernesses in Arizona: Superstition, Salt River Canyon, White Canyon, Needles Eye, Aravaipa Canyon, Galiuro, Santa Teresa, Fishhooks, Bear Wallow, Escudilla, Mount Baldy, Chiracahua, Arrastra Mountains, Tres Alamos, Rawhide Mountains, Harcuvar Mountains, Swansea, East Cactus Plain, Harquahala Mountains, Aubrey Peak, Upper Burro Creek, Hummingbird Springs, Organ Pipe Cactus, Cabeza Prieta, Coyote Mountains, Big Horn Mountains, Baboquivari Peak, and Pajarita Wildernesses. In addition to these 30 designated Wildernesses, this proposal also threatens the Blue Range Primitive Area as well as many Wilderness Study Areas.
Eighteen of these Wildernesses were designated by the 1990 Arizona Desert Wilderness Act, which unfortunately contained a bad special provision that allows military overflights. But that doesn’t mean the proposed action won’t damage those Wildernesses, nor does that 1990 law give the Air Force a free pass to damage the other Wildernesses.
"The Air Force wants to make changes to 10 #MilitaryOperationAreas (#MOAs) to enhance its airspace training capabilities. Specifically, the Air Force wants to lower the altitudes of existing MOAs to support low-altitude training (in some cases, as low as 500 feet above the ground, and in one case, The U.S. Air Force has released a Draft Environmental Impact Statement (EIS) that proposes a massive increase in low-level jet training flights in more than 1.2 million acres of designated Wilderness in Arizona and New Mexico. Such activity would shatter the area’s natural sounds, ruin the wilderness experience for visitors, and stress native wildlife.
"Your help is needed by October 9 to tell the Air Force to keep low-altitude jets, sonic booms, and supersonic flights out of these Wildernesses (link below).
"The Air Force also wants to authorize supersonic training at lower altitudes in more MOAs, lower the minimum release altitude for flares, and authorize use of chaff bundles containing up to 5 million #aluminum-coated silica fibers, which are used to obscure radar, and are designed to stay airborne as long as possible before they settle to the ground."

Breaking News: Federal Judge Denies Restraining Order Filed Against Interior Sec. #DebHaaland by #Tohono #Oodham and #SanCarlos #ApacheNations
By #BrendaNorrell, #CensoredNews, April 17, 2024
TUCSON -- "A federal judge in Tucson denied a restraining order sought against Interior Sec. Deb Haaland by the Tohono O'odham and San Carlos Apache Nations.
"#Haaland is pushing another fake 'green energy' project, and bulldozers are ripping through ancient sites, ceremonial places, and medicine gathering places, for transmission lines to take wind energy from New Mexico to California.
Federal Judge Jennifer Zipps ruled on Tuesday that the tribes and others filing the lawsuit waited too long to file, and the Interior and BLM had fulfilled their obligations to prepare inventory and identify cultural resources.
"The pristine region of the #SanPedroValley in southern #Arizona, is the ancestral homeland of #SanXavier O'oodham, their ancestors #Hohokam, and #Apache."

#Tohono #Oodham Police Vendetta Revealed in Murder of #RaymondMattia
By Brenda Norrell, #CensoredNews
December 21, 2023
"The vendetta of a Tohono O'odham Nation police officer is revealed by attorneys for the family of Raymond Mattia, Tohono O'odham, who was murdered when Tohono O'odham police and U.S. Border Patrol agents fired 38 shots at him, striking him with nine bullets, in front of his home.
"'I don’t know exactly where that motherfucker is at,' a Tohono O'odham Nation police officer told U.S. Border Patrol agents as they met shortly before Raymond was murdered.
"The statement was revealed by the family's attorneys. The Tohono O'odham Nation police department refuses to release the officer's name. Neither the U.S. Border Patrol, nor the Tohono O'odham Nation Police Department, have released all of the officer body cam recordings of Raymond's murder. Only an edited portion has been released to the public.
"Federal prosecutors are now part of the cover-up and refuse to file charges against the officer and agents who fired the shots at Raymond, murdering him in front of his home in Ali Jegk, less than a mile north of the border, on May 18, 2023.
U.S. Department of Justice employees met with the family in Sells to discuss their decision but refused to provide the family with details about what happened that night.
"During a series of interviews between 2011 and 2013, on the border in Raymond's community, Ali Jegk, Raymond told Censored News that he videotaped U.S. Border Patrol agents escorting Mexican cartels bringing drug loads across the border. When Raymond submitted the evidence, it vanished.
"The new details of Raymond's murder are stated by attorneys for his family in a letter, which notified the Customs and Border Patrol of the family's intent to file a wrongful death lawsuit.
"It reveals that Raymond never acted aggressively."

#Arizona tribe protests decision not to prosecute #BorderPatrol agents who fatally shot #RaymondMattia
José Ignacio Castañeda Perez
USA TODAY NETWORK
October 16, 2023
"Federal prosecutors won’t file charges against U.S. Border Patrol agents who shot and killed a member of the #Tohono #Oodham Nation just steps outside his home earlier this year, sparking outrage from the tribe who called the decision 'a travesty of justice.'
"In a statement released last week, the U.S. Attorney’s Office said its employees met with Raymond Mattia’s family and their lawyers to inform the family of their decision not to prosecute on Sept. 19. Representatives from the U.S. Attorney's Office declined to share substantive details about their investigation into the shooting and did not factually answer why they chose not to prosecute, according to Ryan Stitt, a San Diego-based attorney representing the Mattia family.
"Going forward, the family has 'little choice' but to file a civil lawsuit in order to get answers about what happened to Mattia, Stitt said.
"'The government’s decision to not prosecute the agents involved is not surprising,' Stitt said in a written statement. 'Law enforcement officers are rarely prosecuted, even for killing unarmed people.'"

Raymond Mattia’s family said the partial release of body camera footage “feels like a cheap attempt to justify what they did.”

"The case is still under investigation, with the participation of the Border Patrol’s parent agency, Customs and Border Protection, as well as the FBI and the Tohono #Oodham Nation. Of the 10 Border Patrol agents involved in the incident, three opened fire, CBP has said. Those agents are currently on administrative leave. Whether Tohono O’odham #police also opened fire is unclear.
"The family hoped that the body camera videos would provide answers to their questions. When they arrived at a Tohono O’odham police substation last week to view the footage, however, they found that was not the case. Though CBP had confirmed that all 10 agents involved in the incident were wearing body cameras, the family was shown the same 28-minute edited video the agency released to the public last week, which only included video from the three agents who opened fire."

Exclusive: #Indigenous #ClimateActivist #JacobJohns Speaks Out After #MAGA Gunman Shoots Him in New Mexico
December 08, 2023
via #DemocracyNow
"Broadcasting from #COP28 in Dubai, we speak with Jacob Johns, a #Hopi and Akimel #Oodham environmental defender who is leading the #IndigenousWisdomKeepers delegation at COP28. This is his first interview after surviving being shot in the chest by a far-right agitator in September. Johns and other #IndigenousActivists were holding a vigil opposing plans to reinstall a statue honoring the 16th century Spanish conquistador Juan de #Onate in Española, New Mexico, when a 23-year-old shooter wearing a red MAGA hat fired on the crowd. Johns says he died in the airlift on the way to the hospital and is still dealing with medical issues from the shooting, but wanted to come to the climate summit to share Indigenous wisdom with the world. 'We as Indigenous people understand that as the old world dies, that a new one is created and that we must focus on that creation process.'"

Prosecutors add #HateCrime allegations in shooting over Spanish #conquistador statue
AP, November 3, 2023
SANTA FE, N.M. (AP) — "State prosecutors added hate-crime allegations Thursday to charges of attempted murder against a New Mexico man accused in the shooting of a #NativeAmerican #activist amid confrontations about aborted plans to reinstall a statue of a Spanish conquistador in public, at a court hearing Thursday in northern New Mexico.
"Defendant Ryan David Martinez pleaded not guilty to all charges at the arraignment overseen by a district court judge from a courthouse in TierraAmarilla.
"Assistant District Attorney Tony Long indicated that his office will pursue sentence enhancements based on the use of a firearm and try to prove that the shooting was motivated by bias against a particular social group.
"Martinez was arrested on Sept. 28 after chaos erupted and a single shot was fired at an outdoor gathering in Española over canceled plans to install a bronze likeness of conquistador Juan de #Oñate, who is both revered and reviled for his role in establishing early settlements along the Upper Rio Grande starting in 1598.
"The shooting severely wounded #JacobJohns, of Spokane, Washington, a well-traveled #activist for #environmental causes and an advocate for #NativeAmericanRights who is of #Hopi and Akimel #Oodham tribal descent.
"He had joined other advocates for Native American rights as they celebrated with song, prayer and speeches the county's decision not to install the statue that day.
"Under state law, a hate-crime sentence enhancement could extend prison time by up to a year. The firearm-related enhancements could add up to eight years in prison.
"Initial felony charges against Martinez carry possible sentences of up to 16 years and six months in prison, along with possible fines and parole, Long told the court. A misdemeanor charge of reckless driving could add up to 90 days in prison.
"State District Court Judge Jason Lidyard scheduled a jury trial for May 2024. He has ordered that Martinez remain in jail pending trial."

WHAT
THE RED NATION RESPONDS TO RACIST ATTACK ON #INDIGENOUS PEOPLE
WHERE/WHEN
SEPTEMBER 28, 2023 RIO ARRIBA COUNTY ANNEX BUILDING
WHO
CALLING ON ALL NATIONAL, STATE, TRIBAL, COUNTY, AND CITY OFFICIALS, AND MOVEMENT #ALLIES, TO CONDEMN THIS RACIST ATTACK AND DEMAND THE PROTECTION OF INDIGENOUS PEOPLE
WHY
An agitator opened fire on a prayerful celebration in #Tewa Territory (#Española, #NewMexico) shortly after 12PM local time on Thursday, September 28. This was a premeditated act of violence. The agitator shot #JacobJohns (#Hopi and Akimel #Oodham in the torso. Johns was protecting a #peaceful group of community members assembled at the Rio Arriba County Annex Building, along with half a dozen community #peacekeepers. The gunman was heard saying 'let’s do this' to a small group of men immediately before opening fire. At the time of the shooting, community members were celebrating a postponement of the reinstallation of a Juan de #Oñate statue that was previously removed from Alcalde, New Mexico on June 15, 2020. Rio Arriba County officials planned to reinstall the statue on Thursday morning in its new location in front of the county annex building, but postponed the reinstallation after community members and activists mounted pressure earlier in the week. News of the postponement came as a relief to organizers, who turned the planned #PeacefulProtest into an impromptu peaceful celebration with speeches and a community feed.
"Before the shooting, the agitator was seen antagonizing the crowd, saying racist remarks, referring to attendees as 'Indians,' and at one point proclaimed himself to be a follower of #QAnon. The agitator also made a point to introduce himself to the media present and requested to be photographed and filmed. In the moments leading up to the shooting, the agitator attempted to approach the small crowd of mostly Indigenous women and children congregating around the event’s speakers in front of the building’s main entrance. Video evidence shows that Jacob Johns and other community peacekeepers successfully stopped the agitator from approaching the crowd. Eyewitnesses speculate that the shooter was trying to break through the crowd to shoot the speaker, or to jump on the cement pedestal to get a vantage point with the intent of carrying out a mass shooting. Video footage also shows that community peacekeepers did not pursue the agitator once they had successfully removed him to the other side of a wall separating the sidewalk from the complex. Despite this, the agitator reached under his sweatshirt with his right hand, drew a pistol, pointed, and shot one round into the crowd, hitting Johns in the torso. Additional ammo was seen tucked into his belt by eyewitnesses and on camera. Eyewitnesses have confirmed that the agitator quickly adjusted his aim after shooting Johns and pulled the trigger a second time with the intention of shooting Malaya Peixinho, one of the attendees, but the gun jammed, preventing the release of further rounds. Upon realizing he could go no further with his planned attack, the shooter turned and fled into the complex’s parking lot, got into a white Tesla, and sped off. Additionally, eyewitnesses report the shooter attempted to unjam his gun as he fled. The shooter was later apprehended eleven miles away by New Mexico State Police in Pojoaque, New Mexico.
Despite Rio Arriba County citing concerns for 'public safety' as the rationale for postponing the reinstallment, the county offered no protection for Indigenous community members on Thursday. In fact Rio Arriba county and leaders at all levels of government were made well aware of the high possibility of gun violence. Denise Williams, mother of shooting victim Scott Williams, who was targeted at a 2020 Oñate protest, said prior to Thursday’s event she called Governor Michelle Lujan-Grisham’s office, the office of U.S. Senator Martin Heinrich, New Mexico State Police, the office of the New Mexico Attorney General, all members of U.S. Congress representing Valencia County in New Mexico, and all New Mexico state representatives and senators from Valencia County, to warn them of the high chance of gun violence directed at attendees. State senator Elizabeth 'Liz' Stefanics was the only one to respond. Immediately after the shooting Scott Williams’ father, Dan Williams, called the governor’s office again to tell her that she “had blood on her hands” for failing to properly respond to both shootings.
Immediately after the shooting, two Rio Arriba County Annex employees denied children seeking shelter from the shooter entry into the building. They proceeded to come out, yelling at people to leave, and made disparaging comments about attendees and Jacob as he fought for his life feet away from them. The cops did not show up in a timely manner despite the shooter being in the same parking lot as the Rio Arriba County Sheriff’s office, and it took several more minutes for an ambulance to arrive. Eyewitnesses report the complete absence of police intervention. The event’s organizers assembled a community peacekeeping team to provide the only public safety measures present on the ground. Without hesitation, Johns and half a dozen other Indigenous men and allies volunteered. When Johns was shot, it was attendees who provided the first medical response, saving Johns’ life. The first law enforcement officer on the scene ordered the community members providing medical assistance to move away, but they refused because the officer did not identify himself as a medic and made no other attempts to provide assistance.
We are incredibly alarmed that pretrial services have recommended the agitator be released without cash bail. We know from first-hand experience that politically—and racially—motivated shootings like this embolden other like-minded vigilantes who hold the same contempt for #IndigenousPeople and organizers. The agitator and his sympathizers pose a very real and serious threat to all Indigenous people, and to Indigenous women activists specifically. The establishment, which Alex Naranjo himself lauded as 'a system that we’ve lived with for 400 years,' circles its wagons to protect Indian killers who are colonialism’s foot soldiers. This means there is virtually no formal protection or justice for Indigenous people, women, and activists in these times of heightened danger. We call upon all national, tribal, state, county, and city officials, and movement allies, to condemn this racist attack and demand safety and protection for Indigenous people, women, organizations, and communities. We call upon everyone to contact your officials and apply pressure.
Demand the following:
1. Do not release the shooter!!
2. This must be recognized as the racially-motivated hate crime it is at all levels of government.
3. Protect Native women!!
As of now, the shooter is being held at Rio Arriba County Jail in Tierra Amarilla. The bond hearing is scheduled for Monday at 11:30AM at the Rio Arriba Magistrate Court. We will inform the public of any further updates.
